Estate planning

Blending a family requires care and consideration, from living arrangements to estate planning. An experienced estate planning lawyer can help parents in blended families preserve certain assets for their own children (like family property or heirlooms) and still provide for the rest of their family after they pass away.

Everyone needs an estate plan, especially people with children or other dependents who rely on them financially. However, a mixture of children from different relationships, multiple sets of grandparents, differences in assigning guardians for minor children, and each parent’s obligations to provide for their children quickly complicate estate planning. Don’t leave your future to chance and the dictates of Texas Estate Codes. Talk to an estate planning attorney about your options.

Blended Family Dynamics and Estate Planning

One of the most challenging aspects of estate planning for blended families is varied inheritance expectations. You may have to have uncomfortable conversations with your children and stepchildren.

Another challenge is the responsibility of one or both spouses to a former spouse and children from a previous relationship. Accounting for these responsibilities is part of a good estate plan. The last thing many people wish after they pass is for their heirs to squabble over assets.

Crucial Estate Planning Documents for Blended Families

Estate planning documents for blended families are pretty much the same as those used by other families, although the terms of your will, trusts, and other documents may vary.

Your will establishes a guardian for minor children, which can be especially important if you’re in a relationship but not married. You may wish your partner to care for your children, or you and the child’s other parent may have a guardian in mind for your child who isn’t either of your respective partners (see how dynamics can quickly get complex?). A will also allocates assets to your beneficiaries.

You may opt to create one or more trusts, which can be ideal for supporting children from previous marriages while protecting your new spouse’s interests. Your home, for example, could be placed in a trust so your current partner can live in it until they pass. Then, the house can pass to your child, thereby keeping it in your family. A trust can also be created to fund a child’s education or provide funds for their guardian to take care of your child.

Remember to establish a Power of Attorney (POA) for your healthcare, finances, and directives. Without these documents, your wishes for medical care or your money may not be honored (or even known). If you cannot advocate for yourself, medical directives and a medical POA guide your family in making decisions regarding your care, including a DNR or other directives.

Other Special Considerations for Blended Families

An experienced estate planning lawyer can review your situation and responsibilities and create an estate plan that covers the following:

  • Your children’s inheritance, including what you wish to leave children from a previous relationship.
  • Providing for your current spouse. It’s important to balance the spouse’s financial needs with the inheritance rights of children.
  • Addressing the legal rights and expectations of ex-spouses. If you’re paying alimony, you may wish to leave something to the ex or have something stipulated in your divorce decree to fit the ex-spouse.

An Estate Planning Lawyer Can Help Blended Families

If you have a blended family, a comprehensive estate plan can ensure that all your obligations and responsibilities are met. With the help of an experienced estate planning lawyer, you can provide for your child and new spouse and reduce confusion and disputes over your estate after you pass away.
